1. Introduction

This Privacy Policy explains how Qui Vive Foundation (“we”, “us” or “our”) collects, uses, stores and protects information provided by users of the AfriAccess mobile application (the “App”). By using AfriAccess, you acknowledge the practices described in this Policy.

We are committed to handling personal information responsibly and in accordance with applicable data protection and privacy laws. This Policy applies to information collected through the App and to information processed in connection with the App’s features and services.

2. Information We Collect

When you use AfriAccess, we may collect the following information:

• Email Address: collected during onboarding and used to identify or communicate with you in connection with the App.

• Origin Country: the country you identify as your country of origin.

• Current Country: the country in which you indicate that you currently reside or are located.

The App does not require a traditional password-based login. We do not intentionally collect passwords through the onboarding process.

We may also receive technical or usage information that is generated automatically when you use the App, such as device, application, diagnostic, security and service information, to the extent made available through the third-party services used to operate the App.

3. How We Use Your Information

We use information collected through AfriAccess for purposes including:

• creating and maintaining your user profile;

• personalising the content and experience presented to you;

• providing and maintaining App functionality;

• responding to enquiries and providing support;

• maintaining the security, reliability and integrity of the App;

• diagnosing technical issues and improving the App; and

• complying with applicable legal obligations.

We will not use your personal information for purposes materially incompatible with those described in this Policy without providing appropriate notice where required by law.

4. AfriBot and AI Services

AfriAccess includes an AI chatbot called “AfriBot”. AfriBot uses an external AI application programming interface (API) to process user queries and generate responses.

When you submit a query to AfriBot, the query is transmitted to the applicable AI service provider for the limited purpose of generating an answer. AfriBot is intended to answer questions concerning African Union documents. Users should therefore avoid submitting unnecessary personal, confidential or sensitive information in chatbot queries.

We do not sell your personal information to AI providers or other third parties. AI providers may process submitted queries in accordance with their own terms and privacy policies. We take reasonable steps to select and configure third-party services consistently with the intended operation of AfriBot.

5. Firebase and Firestore

AfriAccess uses Firebase services, including Firestore, as part of its backend infrastructure. Information collected during onboarding may be stored in Firestore to create and maintain your user profile.

Firebase is operated by Google and may process information in accordance with Google’s applicable terms and privacy documentation. We configure and use these services for the operation of AfriAccess and do not sell your personal information through Firebase.

Where applicable, Firebase may also process technical, diagnostic or usage information necessary to provide its services.

6. Sharing and Disclosure of Information

We do not sell, rent or trade your personal information to third parties.

We may disclose information to service providers that process information on our behalf where reasonably necessary to operate AfriAccess, including infrastructure, database, analytics, security, communications and AI service providers. Such providers may access information only as reasonably necessary to provide their services, subject to applicable contractual, technical or organisational safeguards.

We may also disclose information where required by law, regulation, legal process or governmental authority, or where reasonably necessary to protect the rights, safety, security or property of Qui Vive Foundation, our users or others.

7. Data Retention

We retain personal information for as long as reasonably necessary to provide and maintain AfriAccess, fulfil the purposes described in this Policy, comply with legal obligations, resolve disputes and enforce applicable agreements.

When information is no longer reasonably required for these purposes, we will take reasonable steps to delete it, anonymise it or otherwise dispose of it securely, subject to legal, technical or operational requirements that may require continued retention.

8. Data Security

We take reasonable technical and organisational measures designed to protect personal information against unauthorised access, alteration, disclosure, loss or destruction.

No electronic transmission or storage system can be guaranteed to be completely secure. Accordingly, while we work to protect information entrusted to us, we cannot guarantee absolute security. Users should also take reasonable steps to protect their own devices and accounts and should not submit sensitive information unnecessarily through AfriBot.

9. Your Privacy Rights

Depending on your location and applicable law, you may have rights concerning your personal information, which may include the right to:

• request access to personal information we hold about you;

• request correction of inaccurate or incomplete information;

• request deletion of personal information, subject to applicable exceptions;

• object to or request restriction of certain processing;

• request portability of information where applicable; and

• withdraw consent where processing is based on consent.

To exercise an applicable right, or to ask a privacy-related question, please contact Qui Vive Foundation using the contact details provided in the App or through the organisation’s official contact channels. We may need to verify your identity before completing certain requests.

10. Children’s Privacy

AfriAccess is not intended to knowingly collect personal information from children in circumstances where such collection is prohibited by applicable law. If you believe that a child has provided personal information to us unlawfully, please contact us so that we can assess and, where appropriate, delete the information.

11. International Data Transfers

Because AfriAccess relies on third-party infrastructure and service providers, including Firebase and AI service providers, information may be processed or stored in countries other than the country in which you are located. Where applicable law requires safeguards for international transfers, we will seek to use appropriate safeguards and contractual arrangements.

12. Third-Party Services and Links

AfriAccess may rely on third-party services to provide functionality, infrastructure or other services. Third parties may have their own privacy policies and terms governing their processing of information.

This Privacy Policy does not govern the privacy practices of independent third parties. We encourage users to review the privacy policies of third-party services before using features that depend on them.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in AfriAccess, applicable law, technology or our data practices. When material changes are made, we will take reasonable steps to provide notice through the App or another appropriate channel.

The “Effective Date” at the beginning of this Policy indicates when the current version took effect.

15. Governing Law

This Privacy Policy shall be interpreted in accordance with applicable privacy and data protection laws. Any legal rights or obligations arising from the use of AfriAccess remain subject to the mandatory laws applicable to the relevant user and to Qui Vive Foundation.
